Second former Trump lawyer predicts defeat at Supreme Court over immunity

Another ex-attorney for former President Trump predicted the Supreme Court would rule against his claims of immunity from criminal prosecution.

Former Trump attorney Timothy Parlatore said on CNN’s “The Source with Kaitlan Collins” that he believes it is likely the Supreme Court will take up Trump’s immunity case and rule against the former president.

“I do see a value in, in the Supreme Court weighing in and potentially clarifying what, you know, what type of conduct would or wouldn’t be under the immunity,” he told CNN host Kaitlan Collins on Tuesday. “I don’t think that it’s going to affect the outcome. I don’t think there’s going to change, you know, what’s going to happen in this trial.”

Earlier Tuesday, a three-judge panel upheld a lower court’s finding, ruling the former president is not immune from criminal prosecution as a former executive and blocking his effort to toss the federal 2020 election case on that argument. Trump has until Feb. 12 to file an emergency appeal with the Supreme Court on his presidential immunity argument.

If the Supreme Court takes on the case, Parlatore said the justices likely would not overturn the district court’s ruling.

“I believe that the Supreme Court is not going to overturn it and find, you know, the blanket immunity that the former president is asking for,” he said.

Parlatore’s prediction echoes another former Trump attorney’s argument. Former White House lawyer Ty Cobb said after the ruling that the Supreme Court would rule unanimously against the former president.

Collins also pressed Parlatore on what he may think about the panel calling him “citizen Trump” in their Tuesday ruling because he had worked closely with the former president. Parlatore left Trump’s legal team representing him in his federal classified documents case last year.

“I think that he’s probably taking more personally, particularly the parts about citizen Trump. I think that he’s probably more concentrating on that. But you know, ultimately, one would hope that his lawyers — and he has some very good lawyers on this particular issue — try to, you know, refocus it on you know, just the legal aspects,” he said.

Trump’s campaign said Tuesday the former president plans to appeal the ruling, with spokesperson Steven Cheung saying Trump “respectfully disagrees with the DC Circuit’s decision.”
